Terms of Use

Please read the Terms of Use for the Program carefully and in their entirety before purchasing and using AHA Academy (hereinafter referred to as the “Program”). The Program and its content are owned by Assist-Her Agency LTD.

1. Definitions

•  “Company”, “We”, “I”, “Our”, or “Us” means Assist-Her Agency LTD. 
•  “Participation”, “Participating”, “Using”, or “Use” means reading, implementing, trying, or otherwise engaging in the Program.
•  “Program” means AHA Academy 
•  “You” or “Your” means the purchaser and person using the Program.

2. Consent

By participating in the Program, you voluntarily agree to act in accordance with and be bound by these Terms of Use.

3. Disclaimer

By participating in the Program, you understand that Gabrielle Tongol and Katy Connan are consultants. This Program is for informational and educational purposes only. Nothing in the Program is intended to substitute or replace professional advice from a lawyer, accountant, or financial advisor. You are encouraged to consult appropriate professionals in your jurisdiction for advice specific to your situation.

While we strive to provide current and accurate information, we make no representations, warranties, or guarantees regarding the accuracy, completeness, or timeliness of the Program content.

4. Assumption of Risk

You agree to use your own judgment in using the information provided in the Program, which is done at your own risk. You accept full responsibility for your actions, decisions, and outcomes related to your use or participation in the Program.

5. Intellectual Property Ownership

All materials within the Program, including but not limited to AHA Academy Essentials and AHA Academy Elevate, are the intellectual property of Gabrielle Tongol, Katy Connan, and Assist-Her Agency LTD. Any reproduction, modification, or distribution without express written permission is strictly prohibited and may result in legal action.

Unauthorized use of our intellectual property may result in claims for damages or other legal remedies in accordance with Canadian copyright and intellectual property laws.

6. No Sharing

You may not share, distribute, forward, or copy the Program materials. This includes login information. Sharing login credentials or unauthorized distribution will result in immediate removal from the Program without a refund and potential legal action.

7. No Claims Made Regarding Results

Testimonials or success stories shared by clients are for illustrative purposes only and are not guarantees of your success. Every individual’s business and results are unique, and we make no assurances or warranties of specific outcomes, including financial gain or business growth.

8. No Warranties or Guarantees

The Program is provided “AS IS” without warranties or guarantees of any kind. To the fullest extent permitted under Canadian law, we disclaim any and all warranties—express or implied—including but not limited to merchantability or fitness for a particular purpose. We are not liable for any loss or damage resulting from your use of the Program.

9. Release, Indemnification, and Hold Harmless

To the fullest extent permitted by Canadian law, you agree to release, indemnify, and hold harmless Assist-Her Agency LTD., including its employees, agents, contractors, directors, and affiliates from any and all claims, actions, damages, costs, or liabilities arising from your participation in the Program or breach of these Terms.

10. Refund Policy

NO REFUNDS: Due to the digital and downloadable nature of the Program, all purchases are final. No refunds will be issued.

11. Chargebacks

You agree not to initiate any chargebacks against the Company. If you do so, we reserve the right to refer the matter to a collections agency in accordance with Canadian debt recovery laws and report the delinquency where permitted.

12. Arbitration & Dispute Resolution

In the event of a dispute or complaint, please contact us at [email protected] to attempt an informal resolution.

If a resolution cannot be reached, both parties agree to submit the dispute to binding arbitration in accordance with the Arbitration Act of Alberta, administered in Edmonton, Alberta, or virtually if agreed upon.

By agreeing to these Terms, you waive your right to a trial by jury or class action. The arbitrator’s decision shall be final and binding. The only remedy you may seek through arbitration is a refund of the amount paid for the Program. No consequential or punitive damages may be awarded.

13. Limitation of Liability

Assist-Her Agency LTD. is not liable for any direct, indirect, incidental, special, or consequential damages resulting from your use or inability to use the Program, including injury, loss, or damages of any kind, to the fullest extent permitted by law.

14. Payment Terms

General Payment

By purchasing the Program, you authorize Assist-Her Agency LTD. to charge your credit or debit card through Kajabi Payments via Stripe, our secure third-party processor. All prices are in Canadian Dollars (CAD) unless otherwise stated.

Payment Plans

If you select a payment plan, your card will be charged every 30 days for 3 or 6 months. You authorize automatic charges without additional consent.

Missed Payments: 

•  1st failed attempt: A 5-day grace period will be given to update your payment method.
•  2nd failed attempt: Program access will be temporarily suspended.
•  3rd failed attempt: We will attempt to charge again within 5 days.
•  4th and final attempt: If unsuccessful, your account will be permanently removed from the Program and may be sent to collections. No refunds will be provided.

By agreeing to a payment plan, you are committing to pay the full program fee.

15. Governing Law & Jurisdiction

These Terms shall be governed in accordance with the laws of the Province of Alberta and the federal laws of Canada. Any disputes not resolved via arbitration shall be subject to the exclusive jurisdiction of the courts of Edmonton, Alberta.
